Terms of Service

1. Acceptance of Terms

These Terms of Service constitute an agreement between you ("User") and PT DEWATA ARTIFICIAL INTELLIGENCE, an Individual Limited Liability Company (Perseroan Terbatas Perorangan) established under the laws of the Republic of Indonesia, domiciled in Bali ("Dewata AI", "We").

By accessing or using Dewata AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

3. Description of Service

Dewata AI is a SaaS platform that allows users to create, train, and deploy AI-powered chatbots on their websites and messaging channels. Our Service includes:

  • Chatbot creation and customization tools
  • Knowledge base management (text and PDF)
  • Widget embedding capabilities
  • WhatsApp Business integration for automated messaging
  • Instagram Direct Message integration for automated responses
  • Telegram Bot integration for automated messaging
  • E-commerce (product catalog, orders, and payment links)
  • Lead management and scoring
  • Customer intelligence and lifecycle tracking
  • Booking management
  • Google Sheets data export
  • Public API v1 access with scoped API keys
  • Channel message management and analytics
  • Usage analytics and reporting
  • RAG-powered semantic search (knowledge base vector embeddings)
  • Persistent customer memory for personalized interactions
  • Workflow automation with rule-based triggers
  • External product catalog sync (Google Sheets, CSV)
  • Scheduled plan changes (deferred subscription downgrades)

4. User Accounts

4.1 Registration

To use our Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials.

4.2 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or illegal content
  • Spam, harass, or deceive users
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Create chatbots for illegal or unethical purposes

6. Subscription and Payment

6.1 Plans

We offer Free, Pro, and Ultimate subscription plans. Features and limits vary by plan as described on our pricing page.

6.2 Credit System

Our Service uses a pay-as-you-go credit system. Each subscription plan includes a base and bonus credit allocation. You may also purchase additional credits through the top-up system at any time. Credits are consumed based on the AI model tier used. Credits are non-refundable, non-transferable, and have no cash value. Credits may only be used within the Dewata AI platform.

6.3 Billing

Paid subscriptions are billed monthly or annually in advance. Payments are processed through Midtrans. Prices are in Indonesian Rupiah (IDR) and include applicable taxes.

6.4 Refunds

We offer refunds within 7 days of subscription purchase if you are not satisfied with our Service. Contact support to request a refund. Credits that have been consumed are non-refundable. Credit top-up purchases are final and non-refundable once credits are added to your account.

6.5 Taxes

Listed prices include Value Added Tax (VAT/PPN) in accordance with applicable tax regulations of the Republic of Indonesia.

7. Intellectual Property

7.1 Our Content

The Service, including its design, features, and code, is owned by Dewata AI and protected by intellectual property laws.

7.2 Your Content

You retain ownership of the content you upload (knowledge base, bot configurations, product catalogs). You grant us a license to use this content solely to provide the Service.

8. AI and Third-Party Services

Our Service uses third-party AI providers (OpenAI, Anthropic) and messaging platforms (Meta's WhatsApp Business API, Instagram Messaging API, and Telegram Bot API). You agree to comply with their usage policies. We are not responsible for the accuracy or appropriateness of AI-generated responses.

9. WhatsApp, Instagram & Telegram Integration

By connecting WhatsApp Business, Instagram, or Telegram Bot to our Service:

  • You confirm you have authority to connect these accounts
  • You agree to comply with Meta Platform Terms of Service (for WhatsApp and Instagram)
  • You agree to Meta's Commerce Policy and Business Messaging Policy
  • You understand that Meta may revoke access for policy violations
  • For Telegram, you agree to comply with Telegram's Terms of Service and Bot Policy
  • You are responsible for the content of AI-generated responses sent via these channels
  • You must not use integrations for spam, unsolicited messages, or prohibited content
  • You must respect opt-out requests from message recipients

10. API Usage

10.1 API Keys

Public API v1 access requires API keys with the dwt_ prefix. API keys are confidential and must not be shared or exposed publicly. You are responsible for all activity conducted using your API keys.

10.2 Rate Limits

APIs are subject to rate limiting to ensure service quality. Current limits include 30 requests per minute for chat endpoints and 60 requests per minute for read endpoints. Exceeding these limits will result in temporary error responses.

10.3 Scoped Access

API keys are granted specific scopes (e.g. chat:write, credits:read, usage:read, bot:read). Only endpoints matching the API key's scopes may be accessed.

11. E-Commerce and Merchant Payments

11.1 Merchant Responsibility

If you use e-commerce features, you are fully responsible for product information accuracy, order fulfillment, and handling customer disputes. Dewata AI acts as a platform provider and is not a party to transactions between you and your customers.

11.2 Payment Gateways

Merchant payments are processed through third-party gateways (Midtrans, Xendit, or Pakasir) as configured by you. You agree to comply with the terms of service of the respective payment gateway. Dewata AI does not store credit or debit card data.

12. AI Transparency

In accordance with Circular Letter of Kominfo No. 9 of 2023 on Artificial Intelligence Ethics, we hereby disclose that:

  • Chatbot responses are generated by artificial intelligence (AI), not by a human
  • AI models used are provided by third parties, namely OpenAI and Anthropic
  • AI responses may not always be accurate, complete, or up-to-date — users are advised to independently verify important information
  • Human oversight is available through the handoff system, where conversations can be transferred to human agents
  • Dewata AI is committed to AI ethics as set forth in Circular Letter of Kominfo No. 9 of 2023

13. Limitation of Liability

Dewata AI is responsible for providing the Service in accordance with the description set forth in these Terms and to a reasonable standard of quality.

Dewata AI's liability for any claim arising out of or related to the Service is limited to the total amount you have paid to Dewata AI in the 12 (twelve) months preceding the claim.

Dewata AI shall not be liable for losses caused by force majeure events, including but not limited to:

  • Natural disasters (earthquakes, floods, volcanic eruptions, tsunamis)
  • Government policies or regulatory changes
  • Internet or telecommunications infrastructure disruptions
  • Pandemics or health emergencies
  • Disruptions to third-party services (AI providers, payment gateways, messaging platforms) beyond our control

14. Disclaimer of Warranties

Dewata AI is responsible for providing the Service as described in these Terms and endeavors to maintain service availability and quality.

However, Dewata AI cannot guarantee the following:

  • Accuracy or appropriateness of responses generated by third-party AI models (OpenAI, Anthropic)
  • Availability of internet services beyond our control
  • Availability of third-party services (Meta, Telegram, Midtrans) beyond our control
  • Continuity of service under force majeure conditions as described in Section 13

15. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through the dashboard settings.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, including but not limited to Law No. 27 of 2022 on Personal Data Protection, Law No. 1 of 2024 on the Second Amendment to the ITE Law, Law No. 8 of 1999 on Consumer Protection, and Government Regulation No. 71 of 2019 on Electronic Systems and Transactions.

18. Dispute Resolution

In the event of a dispute arising from the Service, the parties agree to resolve the matter through the following tiered mechanism:

  • Internal Resolution: Complaints may be submitted via email to contact@dewataai.com. We will provide a response within 14 (fourteen) business days.
  • BPSK: Users have the right to submit disputes to the Consumer Dispute Settlement Body (BPSK) in accordance with Law No. 8 of 1999 on Consumer Protection.
  • Court: If resolution through the above mechanisms is not achieved, disputes shall be resolved through the competent District Court in Bali, Indonesia.

19. Language

These Terms of Service are available in Bahasa Indonesia and English. In the event of any inconsistency between the two versions, the Bahasa Indonesia version shall prevail, in accordance with Law No. 24 of 2009 on the National Flag, Language, Coat of Arms, and Anthem.
